Occupational Diseases
Some jobs can be especially dangerous to workers, the implications for them a contact with toxic or harmful to health that could lead to huge losses for them.
When we speak of illnesses or professional, we mean all those ailments or diseases that are developed, usually progressive and often irreversible, by contact or prolonged or repeated exposure of workers to such substances or environments harmful, many times for not having proper security protection.
Reasoning is necessary in such cases as follows: if the worker had never had the disease of having been assigned to tasks other in the company that does not require that contact with harmful elements, then that disease may be considered professional or occupational.
Another characterization of these would be that their symptoms are more frequent among those who perform a particular profession among the general public.
The real seriousness of this type of scenario
The statistics are very clear, and show that the death toll due to these diseases is much higher than that which occurs as a result of accidents and injuries.
As we advance before, most tragically in relation to them is that, with proper protection available to workers, the risks associated with such diseases could be avoided in most cases totally.
Hence, many times behind such diseases is the negligence of the employer liability can speak of charge by the above conditions developed, arising in favor of the worker the right to receive financial compensation for damages .
Some examples of these
- The cancer developed by many professionals in the nuclear industry and health (in the latter case, the X-rays).
- Diseases such as silicosis or pneumoconiosis, present in the mining and extraction of underground, by contact with harmful particles in suspension.
- Musculoskeletal injuries.
- The respiratory diseases such as obstructive lung of chronic or occupational asthma.
- The industrial deafness.
- Cardiovascular disease, for example lead the work done by the person very high stress levels, precipitating a heart attack in a moment of great tension.
- The psychological.
Your chances if you suffer from any of these
If you had to endure the harmful consequences of this type of pathology, two might be the channels through which palliate the terrible effects:
a) First, you could bring a claim for damages against your company, in the case of your illness could have been avoided, or at least be mitigated in its effects, if they had put at your disposal means of protection from your direct contact with the harmful agent.
b) Secondly, if a cause of it could no longer perform your job, you might ask yourself the opportunity to apply for permanent work disability. This would allow you to get a consistent revenue base to compensate for your loss of income.
