Colombian airlines overbook may be penalized for airline tickets
Sell more seats than it has an airplane is a common practice in the world of airlines, from the smallest to the most important. Companies seek and protect passengers who have purchased your ticket, but not present at the time of shipment, usually, because at the last minute decided to change the date of travel or because they presented a sudden. Although the generally accepted level of overbooking is up to ten percent on the availability of seats, some companies tend to stretch that percentage in some points. Consequently, having a confirmed ticket does not guarantee absolutely that you will receive the contracted service, especially when for reasons that were reached near the time of flight departure.
Given the consistent practice of the different airlines within Colombian territory, in short that violated the rights of consumers, the national air traffic control, civil aeronautics, has developed new rules designed to avoid some of these practices, as the case the resolution which penalizes airlines that oversell seats.
The airlines that oversell a flight by a margin exceeding 5% of available passenger capacity will be severely punished with a fine penalty for three to five current legal monthly minimum wage, especially if overbooking is performed in peak season .
This is indicated in Resolution 3579 of the Civil Aeronautics, which amended the existing aviation regulations do not impose any penalty on the matter.
The penalty should be imposed, even if only just a quota has been oversold or passenger in excess of 5% and will increase the minimum wage additional for each passenger quota or for which the violation is incurred.
Also operate when, in case of overbooking, or the loss, misplacement or destruction of baggage of passengers, the airline will not take any action to compensate the affected users.
Thus, the Colombian Civil Aeronautics, whose functions promote and regulate the development, coverage and the growth of civil aviation, industry and aeronautics research, expect greater compliance with air traffic rules by the national and international airlines providing service in Colombia.
