¿Presumption of innocence?
I listened on the radio this morning that the Minister was proposing Pajín in the Council of Ministers has today made a reform of the Civil Code in order to deprive the accused custody for a crime of mistreatment. Well, the Minister has proposed and the Council of Ministers has ruled that such reform is taking place. Given this fact can open several questions, but for me the most interesting and important is what happens to the application of the presumption of innocence?
Again, this principle is violated by a trial balloon of a Minister or Minister with populist mood. There is no doubt that violence is a scourge throughout the whole society should try to remove without excuses. Given the offender's Law (and other legal actors) should act with all his weight, but that is before the / her abuser / a, ie a person who has been finally sentenced guilty of a crime of mistreatment or gender violence. The abuse, and especially gender-based violence are a scourge that must be removed with effort, education and good will. An excess of laws does not imply greater compliance with them.
